Duties and Function of Solicitor General II


The Solicitor General II’s office was created in 2007 to assist the Attorney General to carry out his duties under Clause (2) of Article 145 of the Federal Constitution which is to advise the Yang di-Pertuan Agong or the Cabinet or any Minister upon such legal matters, and to perform such other duties of a legal character, as may from time to time be referred or assigned to him by the Yang di-Pertuan Agong or the Cabinet, and to discharge the functions conferred on him by or under the Federal Constitution or any other written law.

The Solicitor General II, like the Solicitor General is empowered under Section 40A of the Eleventh Schedule to the Federal Constitution to exercise the powers of the Attorney General unless expressly provided otherwise in any written law.

The Solicitor General II is responsible to lead, supervise and monitor the Litigation Sector on behalf of the Attorney General. The Litigation Sector in the Attorney General’s Chambers consist of the Prosecution Division, the Appellate and Trial Division, the Civil Division and the Special Litigation Unit.
