General Functions
  1. Providing legal advice on international matters to the Government of Malaysia.
  2. Drafting, vetting and/or provide comments on international instruments and documents such as Treaty, Memorandum of Understanding, Declaration, Special Rapporteur and Joint Communique.
  3. Providing AGC’s comments and input to the Cabinet Memorandum forwarded by Ministries.
  4. Drafting, vetting and/or provide comments on draft Bill or subsidiary legislation for the implementation of Malaysia’s obligations under a treaty/international instrument.

Unit 1 - Border, Territorial and Maritime Matters

Providing legal advice to the government of Malaysia on matters relating to border, territorial and maritime matters with a view to protect national interest, including the following matters:

  • Law of the sea and maritime law including the United Nations Convention on the Law of the Sea 1982 (UNCLOS) and other related instruments.
  • Territorial matters and overlapping claims.
  • Delimitation of international maritime boundaries.
  • Demarcation of international land boundaries.
  • Shipping and safety of navigation.
  • Enforcement of maritime law.
  • Settlement of disputes relating to border, territorial and maritime matters.
Unit 2 - Human Rights and International Organization

1. Providing legal advice on matters relating to human rights and international organisation with a view to protect national interest including:

  • Human rights;
  • Declaration of an organization to be an international organization;
  • Privileges and immunities of an international organization;
  • Employment and labour standards;
  • Universal Periodic Review;
  • Malaysia’s periodic reports on the implementation of the Convention on the Elimination of All Forms of Discrimination against Women, Convention on the Rights of the Child and Convention on the Rights of Persons with Disabilities;or
  • Malaysia’ ratification/accession to core international human rights instruments
  • Human Rights Commission of Malaysia (SUHAKAM).

 

2. Coordinating participation of the Attorney General’s Chambers’ officers in various meetings organized by international organizations such as the United Nations, Asian-African Legal Consultative Organization (AALCO), Commonwealth and ASEAN.

Unit 3 - International Criminal Matters

1. Providing legal advice on matters relating to international criminal matter with a view to protect national interest including:

  • Transnational Crime including Terrorism, Corruption, Money- Laundering, Trafficking in Persons and etc;
  • Genocide, War Crimes,Crimes Against Humanity and Crimes of Agression;
  • International Criminal Court;
  • International Court of Justice;
  • Non-Proliferation of Weapons of Mass Destruction;
  • Disarmament;
  • War Crimes Law;
  • International Humanitarian Law;
  • International Transfer of Prisoners; and
  • Legal Co-operation Activity Agreement.

 

2. Study, review and if necessary, to prepare for international claims on behalf of the Government of Malaysia or defending claims against the Government of Malaysia.

Unit 4 - Bilateral and ASEAN Trade and International Finance

  • Providing legal advice on matters relating to Bilateral and ASEAN trade and International Finance with a view to protect  national interest
  • Participate in meetings and negotiations of bilateral Free Trade Agreements (FTAs), ASEAN FTAs, international taxation agreements and international finance agreements and other related international trade agreements and conventions.
  • Represent AGC and the Government of Malaysia in trade dispute settlement process under the World Trade Organization (WTO) and Free Trade Agreements.
  • Negotiating dispute settlement mechanism in the FTAs.
Unit 5 - Multilateral Trade, International Arbitration and Dispute

  • Providing legal advice on matters relating to multilateral trade, international arbitration and disputes with a view to protect national interest.
  • Providing legal advice on matters arising from international investment treaties.
  • Coordinator for the United Nations Commission on International Trade Law (UNCITRAL) Working Groups.
  • Analyse, study and if necessary, to make preparation for any international disputes by or against the Government of Malaysia. 
  • Representing the Government of Malaysia in international disputes which arises from international treaties. 
  • Negotiating dispute settlement mechanism such as arbitration or alternative dispute resolution in trade agreements other than FTAs.
 Unit 6 - Environment, Space, Civil Aviation and Private International Law

Adilla binti Ahmad

  • Providing legal advice on matters relating to environment, space, civil aviation and private international law with a view to protect national interest.
  • Carry out study and research in relation to legal issues pertaining to environment, space, civil aviation, and private international law.
  • Drafting and/or vetting of domestic legislation for the implementation of Malaysia’s obligations under a treaty/international instrument pertaining to environment, space, civil aviation, and private international law.
  • Attend seminars, workshops, meetings, discussions or negotiations, at domestic and international level, in particular negotiations on the proposal to develop a treaty or an international document pertaining to environment, space, civil aviation, and private international law.
  • To act as the coordinator for the Attorney General’s Chambers which was appointed as the national organ for purposes of dealing with any matters pertaining to Malaysia’s membership in the Hague Conference / Conférence de la Haye (Hague Conference on Private International Law) (HCCH).
