Functions
  • Prepare and provide legal advice, legal opinions, second legal opinions, feedbacks, comments and inputs in relation to Syariah-related issues.
  • Vet legal documents such as agreements and memorandum of understanding in relation to Syariah-related issues.
  • Provide comments on policy papers, including Cabinet Papers in relation to Syariah-related issues.
  • Vet and study any issues relating to hukum Syarak and Syariah laws in relation to bills of Parliament and subsidiary legislation.
  • Conduct legal research and make appropriate proposals for the purpose of standardisation and coordination of Syariah laws between States.
  • Conduct legal research and make proposals for the purposes of harmonisation of laws i.e. between civil laws and Syariah laws in order to resolve issues with regard to conflict of jurisdiction between the civil court and the Syariah court.
  • Represent Ministries, Departments and agencies in civil cases before the Syariah courts.
  • Assist the Civil Division in the handling of cases in relation to Syariah-related issues in civil courts.
  • Prepare inputs for bodies, institutions and committiees of which the Attorney General or the Attorney General's Chambers in a member.
  • Undertake supervision and inspectorate activities towards legal officers posted to the Islamic Religious Development of Malaysia (JAKIM) as well as Assistant State Legal Advisors (Syariah) attached to the State Legal Advisors' office.
  • Conduct Syariah Community Conferences and Syariah Community Meetings to obtain views, feedbacks and inputs in relation to Syariah-related issues.

Constitutional, Administration of Islamic Affairs and Litigation Unit

  • This Unit deals with constitutional issues and laws relating to the administration of Islamic affairs and hukum Syarak, and handles matters relating to the international conventions and treaties from the Syariah perspective.
  • This Unit also represents the Ministries, Departments and agencies in civil cases before the Syariah courts and handles cases involving hukum Syarak and Syariah law in civil courts together with the Civil Division.
 
Syariah Judiciary and Islamic Family Law Unit

  • This Unit handles legal issues relating to Syariah judiciary including issues relating to the status, membership and jurisdiction of the Syariah court.
  • This Unit also handles matters relating to Islamic family law such as issues pertaining to marriage, divorce, enforcement of maintenance order and right to custody of child.
 
Harmonisation and Co-ordination of Law Unit

  • This Unit handles matters relating to the uniformity and co-ordination of the Syariah laws in the States and harmonisation between civil laws and Syariah laws in order to resolve issues on conflict of jurisdiction between civil courts and Syariah courts.

  • This Unit deals with legal issues relating to muamalat including Islamic banking and finance. This Unit also supervises and monitors legal officers attached to the Department of Islamic Development Malaysia (JAKIM) and the Islamic Religious Council of the Federal Territories (MAIWP), and Syariah officers serving as Assistant Legal Advisors (Syariah) in the State Legal Advisors' Office.
